Real Ideas Studio Student Filmmaking Cannes Program Terms and Conditions

Participation in the Real Ideas Studio program Reel Ideas Studio Student Filmmaking Cannes ("Program") constitutes participants full and unconditional agreement to and acceptance of the Programs Application Process. Contest managed by Real Ideas Studio, Inc. www.realideasstudio.org.

1. Timing

Application process for the Program begins on August 15, 2009, and ends on December 1, 2009 or upon the acceptance of all available positions if occurs prior to December 1, 2009. All applications must be received by Real Ideas Studio no later than 5 p.m. Pacific time on December 1, 2009. Applicants will be reviewed as received and notification of acceptance made at the discretion of Real Ideas Studio, Inc up until all positions are filled.

2. Eligibility

Program is open to all individuals age 18 years or older students studying the creative arts disciplines including but not limited to, Film, Motion Graphics, Post Production, Communication, Public Relations and Marketing disciplines currently or are a professional in the film and creative arts industry who is seeking professional development for acquiring new skills and education from any governed nation around the world who hold citizenship status or have official work or student visas for the countries they currently reside in.

3. Portfolio Requirements

In addition to the application form, the following portfolio “show and tell” must be submitted:

The following applicants for the positions including Director, Producer, Camera, Post Production, and Motion Graphics must submit materials to below specified sharing sites and provide a direct linking URL to the video/film content at either of the following:

If accepted into the program, the portfolio must be submitted to Real Ideas Studio either a QuickTime or AVI format with accompanying original digital files.

4. How to Apply:

Application entry forms are exclusively available from the Program web page at www.realideasstudio.org. Complete the application form online in its entirety. Each application must include the following:

A. A completed web application form or email pdf form,

B. A Portfolio submission, created not earlier than January 1, 2009, within one of the 5 designated roles above.

Any application missing any of the above information would be considered incomplete.

5. Copyright Ownership:

By submitting an application, the applicant warrants that applicant is the sole designer, creator, and owner of the artwork and or content, including all visual and auditory components, or has permission to use copyrighted components, and further warrants that the artwork and or content does not contain information considered by applicants place of business or any other third party to be confidential.

6. Accepted Applicant Notifications:

Applicants accepted will be notified by e-mail, and or telephone and will have ten (10) days from the notification to acknowledge applicants acceptance status and confirm process for payment of the tuition for the program. If accepted applicant does not confirm their acceptance, Real Ideas Studio, has the right to revoke the acceptance and accept another applicant in their place.

7. Payment of Tuition;

Applicants who are accepted into the program must provide payment in full for the program no later than April 20, 2009. If payment is not received by April 20, 2009, the Applicant agrees that they have released their position in the program because of non payment. Payment may be made by Credit Card, Check drawn upon $US funds or via wire transfer.

8. General Terms and Conditions:

Real Ideas Studio, Inc. is not responsible for and shall not be liable for: (i) lost, late, delayed, damaged, incomplete, illegible, unintelligible, or misdirected applications; (ii) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures, or difficulties of any kind; (iii) failed, incomplete, partial, garbled, or delayed computer transmissions; (iv) any condition caused by events beyond the control of Real Ideas Studio that may cause the applicants application to be disrupted or corrupted; (v) any injuries, losses, or damages of any kind arising in connection with or as a result of acceptance or participation in the Program; (vi) any printing or typographical errors in any materials associated with the Program; (vii) or any regional, state, autonomous, or local laws or regulations violated during the creation of the documentaries in the program by the participants. Real Ideas Studio, Inc. reserves the right to suspend, cancel, or modify the Program if fraud or technical failure corrupts the administration, security, or proper management of the Program, as determined by Real Ideas Studio, Inc. Each Applicant agrees to release and hold Real Ideas Studio, Inc. harmless from any and all losses, damages, rights, claims, and actions of any kind in connection with the Program or resulting from acceptance in the Program, including, without limitation, personal injury, death, property damage, and claims based upon intellectual property infringement, publicity rights, defamation, or invasion of privacy. Notwithstanding the foregoing, the preceding release of liability will not apply with respect to personal injury, death, or damage to property caused by Real Ideas Studio, Inc. Each Applicant agrees that Real Ideas Studio, Inc. only obligation is to manage and deliver the instruction to aid the process of the program for the accepted participants. Applicant agrees that Reel Ideas Studio, Inc. obligation is fair and adequate consideration for any submitted applicant and that applicant is not entitled to and shall not seek any further compensation.

Each Applicant agrees that if his or her application is selected as a participant, as a condition of receiving acceptance, the Applicant shall sign a license agreement granting Real Ideas Studio, Inc, at the conclusion of the program a royalty-free, non-exclusive, perpetual, worldwide license to use, reproduce, distribute, publicly perform, publicly display, modify for purposes of publicly performing and publicly displaying, and prepare derivative works based upon participants content created during the program, for the purposes of advertising and promoting the program, and for inclusion in and distribution with Real Ideas Studio, Inc or any other named sponsors at the conclusion of the program products. To the extent that such a perpetual license is ineffective or unenforceable, applicant shall sign a license agreement providing to Real Ideas Studio at the conclusion of the program a royalty-free, non-exclusive, two-year (2), worldwide license to use, reproduce, distribute, publicly perform, publicly display, modify for purposes of publicly performing and publicly displaying, and prepare derivative works based upon participants work during the program, for the purposes of advertising and promoting Real Ideas Studio, Inc at the conclusion of the programs products in the future.

Each Applicant further agrees to execute any and all documents necessary to effectuate such license. Each Applicant agrees that by submitting an application, he or she allows the use of his or her personal data, name, likeness, and/or voice in publicity or advertising relating to the Program without compensation. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Applicant Guidelines, or the rights and obligations of Applicant and Real Ideas Studio, Inc. in connection with the Program, shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of California or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of California. Where permitted by law, Applicant agrees that any and all disputes, claims, and causes of action arising out of or connected with this Program, other than the administration of the Program or the determination of the participants, shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Northern District of California (San Jose Division) or the appropriate California State Court located in Santa Clara County, California.
